As wellness programs continue to increase in popularity and practice, we’ve seen a flood of guidance from the agencies and more court rulings on challenges to program designs. We’ll explain how the rules under HIPAA, GINA, the ADA, and health care reform affect wellness program design and administration—and how employers and their advisors can put these rules into practice to design and implement effective and compliant programs. Topics include the EEOC’s 2016 final regulations under GINA and the ADA, the notice and confidentiality requirements, IRS guidance on the taxation of wellness rewards, and the treatment of wellness incentives under the employer shared responsibility rules.
